  1. The promoter of the prize draw is National Express Limited of National Express House Birmingham Coach Station, Mill Lane, Digbeth, Birmingham, B5 6DD (company number 00232767) (“National Express”).
  2. This prize draw is open to all UK residents aged 18 or over, except for employees of National Express and its group companies, their families and agents or any third party directly associated with administration of the prize draw.
  3. To take part in this prize draw, participants need to:
    1. purchase and pay for a ticket for travel on any National Express scheduled UK coach service from www.nationalexpress.com using the Clearpay payment method (the “Booking”); and
    2. having completed the Booking, click on the link that is presented on the booking confirmation page and complete the prize draw form to enter. National Express confirms that the cost of the Booking has not been increased for the giving of the prize.
  4. There is a limit of one prize draw entry per person. Entries on behalf of another person will not be accepted and joint entries are not permitted. By entering the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win. National Express may require you to provide proof that you are eligible to enter the prize drawn and claim any prize you may win.
  5. The prize draw runs from 09:00 am on Thursday 27 October 2022 and closes at midnight on Monday 31 October 2022 (the “Closing Date”). Entries received after the Closing Date will not be valid and will not be entered into the prize draw.
  6. The winner will be chosen by random draw performed by a computer process that produces variable results by no later than five (5) working days after the Closing Date.
  7. There are a total of six (6) individual prizes:
    1. the main prize is a holiday with National Express Leisure for up to four (4) people and a maximum value of £2,000 (the “National Express Leisure Holiday”); and
    2. there are five (5) runner up prizes of five (5) one (1) year adult passes for travel on National Express scheduled UK coach services (excluding Northern Ireland) (the “Annual National Express Coach Pass”).
  8. The National Express Leisure Holiday must be taken before 31 December 2023, is subject to availability and is subject to Lucketts Travel Terms and Conditions available at https://www.lucketts.co.uk/holiday-terms/
  9. The Annual National Express Coach Pass is for travel on the National Express scheduled UK coach network (excluding Northern Ireland) and is subject to availability on the chosen service. All travel is subject to National Express’ General Conditions of Carriage available at https://www.nationalexpress.com/en/help/conditions-of-carriage.
  10. The winner will be notified by email sent to the email address provided by the entrant at the time of entry by midnight on Monday 7 November 2022.
  11. If the winner does not respond to National Express within five (5) days of being notified via email, the winner's prize will be forfeited and National Express will be entitled to select another winner in accordance with the process described above.
  12. The prize will be sent to the email address provided by the entrant at the time of entry. Such email will provide details on how to claim the prize.
  13. The prize is non-exchangeable, non-transferable and no cash alternative is offered. The prize may not be claimed by a third party on your behalf.
  14. National Express reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond National Express’s control makes it necessary to do so.
  15. The decision of National Express regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
  16. National Express must either publish or make available information that indicates that a valid award took place. To comply with this obligation, National Express will send the surname and county of the prize winner and, if applicable and in accordance with Data Protection Laws a copy of the winning entry, to anyone who emails marketing@nationalexpress.com, or writes to National Express House Birmingham Coach Station, Mill Lane, Digbeth, Birmingham, England B5 6DD (enclosing a self-addressed envelope) within one (1) month of the Closing Date. If you object to any or all of your surname, county and winning entry being published or made available, please notify marketing@nationalexpress.com and data.protection@nationalexpress.com. In such circumstances, National Express must still provide the information and winning entry to the Advertising Standards Authority on request.
  17. By entering the prize draw, you are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. National Express reserves the right to refuse to award the prize to anyone in breach of these terms and conditions.
  18. Insofar as it is permitted by law, National Express, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of National Express, its agents or distributors or that of their employees. Your statutory rights are not affected.
  19. Personal data supplied by you during the course of this prize draw will only be processed in accordance with our Privacy Policy at https://www.nationalexpress.com/en/offers/partners/clearpay-competition. See also condition 16 with regard to the announcement of winners.
  20. The prize draw will be governed by English law and entrants to the prize draw submit to the jurisdiction of the English courts.
  21. No responsibility can be accepted for any prize draw entries that are lost, mislaid, damaged or delayed, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind, and incomplete entries will be disregarded.
  22. National Express reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw.
  23. If there is any reason to believe that there has been a breach of these terms and conditions, National Express may, at its sole discretion, reserve the right to exclude you from participating in the prize draw.
  24. National Express reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.

1. Who does this privacy notice apply to, and what is it about?

This privacy notice applies to personal data submitted in connection with the Prize Draw. This privacy notice applies to you and the personal data you submit in connection with the Prize Draw (“Person”). References to “you” and “your” in this privacy notice shall be references to you.

This privacy notice explains:

  • who is the controller of your personal data;
  • what personal data we collect about you;
  • what we do with your personal data and on what legal basis;
  • your rights in respect of your personal data; and
  • what to do if you have any questions or complaints about our use of your personal data.

We take your privacy very seriously and are committed to abiding by the Data Protection Laws which protect your privacy.

It is your responsibility to read this privacy notice and to make each Person aware of this privacy notice.

 

2. Who is the controller of your personal data?

National Express Limited, trading as National Express, is the controller of your personal data for entering the Prize Draw.

The Data Controllers processing personal data for the purposes of the Winner obtaining the Prizes will be Lucketts Travel and National Express Leisure, both respective privacy notices can be found on their websites.

 

3. What personal data do we collect about you, and how?

We may collect the following types of personal data about you in connection with the Prize Draw:

  • your first and surname;
  • your email address;

The winner of the Prize Draw will be notified by the above contract information, at this time we will ask you to provide the county in which you reside.

To comply with the Prize Draw Terms and Conditions, your Prize Draw entry, county and surname must either be published or made available upon written request. We may be required to supply this data to the Advertising Standards Authority upon request. This data indicates that a valid award took place. To comply with our Prize Draw obligation, we will have to share this data of each Prize Draw winner. If you object to any of your personal data, (e.g., surname, county of residence and winning entry) being shared you can contact promotions@nationalexpress.com and/or data.protection@nationalexpress.com.

We do ask you if you want to share your marketing preferences, (e.g., opt-in or out of marketing). This is not a condition of the Prize Draw. You can still enter the Prize Draw and opt-out of marketing.

In addition, each time you visit our website we may automatically collect the following information:

technical data, including:

  • IP address;
  • browser type and version;
  • time zone setting and location; and
  • operating system and platform;
  • information about your time on the site, including:
    • the full Uniform Resource Locators (URLs) clickstream to, through and from our website (including date and time); and
    • time on page, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks and mouse-overs) and methods used to browse away from the page.

 

4. What we do with your personal data and on what legal basis

We use your personal data for the following purposes and describe below the legal basis on which we process your personal data:

5. What are our obligations to collect, and your obligations to provide, personal data?

We have no legal obligation to collect personal data about you, but we need to collect personal data in order to enter you into the Prize Draw and to administer the Prize Draw in accordance with the Prize Draw terms and conditions.

You have no legal obligation to provide us with any personal data. However, if you do not provide the information we need, we may not be able to enter you into the Prize Draw or award your prize if you are a winner.

 

6. Who will we share your personal data with?

We may share your personal data with:

  • other National Express Group companies;
  • if you are a winner, members of the public who request winners’ surnames and counties of residence (unless you object in accordance with the Prize Draw terms and conditions);
  • our suppliers, sub-contractors and business partners who supply services to us and/or on our behalf;
  • our legal and professional advisors;
  • government bodies and regulatory authorities and bodies, including the Advertising Standards Authority;
  • the courts and other dispute resolution arbitrators and mediators, other parties to legal proceedings; and
  • other companies that take on any part of our business as a result of a restructure, merger or transfer of that part of our business.

 

7. For how long will we process your personal data?

We will process the personal data for as long as the Prize Draw is open and for so long thereafter as is necessary for us to manage the outcome of the Prize Draw.

Typically, we will retain information about you if you are a winner of the Prize Draw for up to 18 months after the close of the Prize Draw or if you are an unsuccessful Prize Draw entrant, for up to 6 months after the close of the Prize Draw.

Where we process data with your consent, for example, to send you marketing information, we will process such personal data until you withdraw that consent. Please bear in mind that it may take a short time to process any withdrawal of your consent. We aim to do this within 72 hours of receipt of your request, although you may still receive emails that are already in process around the time of your withdrawal

We may also need to retain information about you for longer where any complaints are made or claims arise in relation to the Prize Draw, or your participation in the Prize Draw, or otherwise where we are required by law, regulation or the rules or orders of courts to retain information for longer.

We may also retain your personal data for longer if we cannot delete it for legal, regulatory or technical reasons.

 

8. Do we transfer your personal data outside of the UK?

There may be occasions where it is necessary to transfer your personal data to a country outside of the United Kingdom (“UK”). It is possible that the country concerned may not be deemed to provide a similar level of protection for individuals’ rights in relation to their personal data as in the UK.

Where we transfer your personal data to other National Express Group companies and/or third parties who process your personal data on our behalf in countries outside the UK, we ensure a similar degree of protection is afforded to it by implementing one of the following safeguards:

  • we transfer to a country that has been deemed to provide an adequate level of protection for personal data; or
  • where the country has not been deemed to provide an adequate level of protection for personal data, we will have entered into contracts approved for use in the UK which give personal data the same protection as it has in the UK.

9. What rights do you have in relation to your personal data?

You have a number of rights under Data Protection Laws in relation to your personal data. These include the right, subject to exceptions, to:

  • access your personal data;
  • request rectification or erasure of your personal data;
  • request restrictions on the processing of your personal data; and
  • object to our processing of your personal data.

If you wish to exercise any of these rights please contact the National Express UK Data Protection Officer.

You also have the right in some circumstances to receive a copy of your personal data in a portable format. This right is limited to personal data that you have provided to us and is processed on the basis of your consent or any contract with us. It does not cover personal data that we process on the grounds of legitimate interest.
