#WinDough Competition Terms and Conditions

1. THE PROMOTER

The promoter of the prize draw is National Express Limited of National Express House Birmingham Coach Station, Mill Lane, Digbeth, Birmingham, England B5 6DD (“National Express”).

2. THE COMPETITION
   • The title of the competition is “#WinDough”.
   • This is a monthly competition in which we are inviting customers to submit a photograph of the view from their coach window whilst onboard the coach or a photograph of themselves onboard the coach through specified social media set out at Condition 3.4 of the view from their National Express coach seat window (a “Photograph”) to us for the chance to win a £25 Amazon voucher.

3. HOW TO ENTER
   • The Monthly Photo Competition will run from 00:01 hours on 5 July 2024 to midnight on 31 July 2025.
   • There will be twelve (12) individual competitions which will run from the first day of each month to midnight on the last day of each month (the “Closing Date”).
   • All competition entries must be submitted through the process set out at Condition 3.4 by no later than midnight on the relevant Closing Date. All competition entries received after the relevant Closing Date will be automatically entered into the next month's competition. Competition entries received after midnight on 31 July 2025 will not be valid.
   • To enter the competition, post your Photograph from on board a National Express coach to your Instagram, Facebook or X account feeds or stories with the hashtag ‘#WinDough’ and tag ‘@nationalexpress’.
   • The competition is free to enter and no purchase is necessary.
   • All Photographs must:
     • Taken from your seat with your seat belt on at all times, you may take a photograph of the front window of the coach as long as this condition is met and that no other passenger is captured in the photograph;
     • be high resolution;
     • show you and/or a passenger travelling with you as part of your customers journey on the coach, be that through the view through the coach seat window or of you or a passenger travelling with you with a scenic and/or recognisable background in the coach window. Do not take any photographs of other passengers; and
     • National Express requests that you do not share any images to our social media channels of any children even if they are a passenger travelling with you. If, however, you are travelling with a child we will not accept this image into the competition, as the images have to be of a young person/adult 18 years and over.

• In terms of competition entries, we will not accept:
  • responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
  • proof of transmission as proof of receipt of entry into the competition.
• By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
• The competition entries will be judged by a panel of three (3) judges who will decide on the winner based on specific requirements. The decision of the panel of judges (acting reasonably) will be final.

4. ELIGIBILITY
   • This competition is open to all UK residents aged 18 or over, except for employees of National Express and its group companies, their families and agents or any third party directly associated with administration of this competition. We will check the winner’s age when contacting them to give the prize. If an entrant cannot provide relevant identification, they will not be given the prize.
   • In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. We may require you to provide proof that you are eligible to enter the competition.
   • There is no limit on the number of entries per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
   • We will not return competition entries or Photographs to , we will retain the image for the purposes of administering the competition.
5. THE PRIZE
   • The prize is a £25 Amazon voucher.
   • The prize is not negotiable or transferable and there is no cash alternative for the prize.
   • We reserve the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond our control make it necessary to do so.
   • In order to claim the prize you must provide a valid email address.

6. WINNERS
   • The winner of the competition will be announced within five (5) business days of the relevant Closing Date (the “Announcement Date”).
   • Our decision is final and no correspondence or discussion will be entered into.
   • We will contact the winner personally as soon as practicable after the relevant Announcement Date, by messaging the exact social media account the entry was originally posted on, where we will ask for an email address to send the prize to. We will only ever message you from our official @nationalexpress social media accounts, please do not give out any information to any other account.

7. CLAIMING THE PRIZE
   • If you are the winner of the prize, you will have ten (10) business days from the Announcement Date to claim the prize. If you do not claim the prize by this date, your claim will become invalid.
   • The prize may not be claimed by a third party on your behalf.
   • We will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within ten (10) business days of the Announcement Date, we reserve the right to withdraw the prize for that month.
   • We do not accept any responsibility if you are not able to take up the prize.

8. LIMITATION OF LIABILITY

Insofar as is permitted by law, we, our agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by our negligence or negligence of our agents or distributors or that of their employees. Your statutory rights are not affected.

9. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
   • All competition entries and any accompanying material submitted to us, including the copyright in the Photograph, will become our property as a Data Controller on receipt and will not be returned.
   • By submitting your competition entry and/or Photograph you agree to:
     • assign to us all your intellectual property rights in the competition entry and/or Photograph with full title guarantee;
     • use of the Photograph on our social channels, website, internal / external communications which may be world wide; and
     • waive all moral rights, in and to your competition entry and/or the Photograph and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time.

10. DATA PROTECTION
    • We will only process your personal information as set out in the privacy policy statement.
    • We will only collect your name, social media handle, photograph, where you are the focus and/or an image of yourself or a passenger over 18 years of age who is travelling with you and have agreed to be part of the Photograph competition and to allow us as a Data Controller to process this image as set out in clause 9 above. We will also collect your email address so we can notify any of the prize winners. Your name will be used to credit the Photograph and the email address will be used to contact the winner and send the prize.  Email addresses are deleted once the winner has received their prize or within 1 month if the prize has not been redeemed.     • We may need to share your personal data, (name and location of where you live, (e.g., county no address) under competition rules if we receive a request from any party wishing to verify an entry and winner. We will comply with the Data Protection Act 2018 in relation to any requests for personal data.

11. GENERAL
    • If there is any reason to believe that there has been a breach of these terms and conditions, we may, at our sole discretion, reserve the right to exclude you from participating in the competition.
    • We reserve the right to hold void, suspend, cancel, or amend the competition where it becomes necessary to do so.

These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
